Personal Information: As part of the registration process, ‘Lalaa Ji’ app may collect the following personally identifiable information about the user: name including first and last name, email address, mobile phone number and other contact details. These details are required to facilitate home delivery of goods and’ Lalaa Ji’app will not trade this data with any entity whatsoever. A similar undertaking is mandatory for the merchants.

Eligibility: The Lalaa Ji app aims at providing an interactive electronic platform to further strengthen the pre existing off line relationship between a local merchant and his regular customers by providing an online interactive platform. An eco system of demand and supply transactions existing for decades wherein both merchant and his buyers know each other by face if not by name. The Lalaa Ji app is available for use in areas having adequate internet connectivity and where, both merchant and customer use smart phones.

Players Explained:

a) Merchant: A merchant is a local store owner who has been running his enterprise (grocery, stationery, pharmacy, eatery, laundry, dairy & vegetable etc) in a community set up, for example in a colony, mohalla, local market and has been trading with regular customers and is interested in providing home delivery services or ready pick up facility for his customers to insure Covid 19 pandemic related safety protocols as per the government directives. The said merchant downloads the Lalaa Ji app and set up his shop with name and photos. After registration the merchant generates a unique QR Code and a unique shop identification number for his shop and shares it with his customers either by printing and displaying the code at the shop front, sharing it on Whatsapp or putting it on his Google Business profile. The customer too needs to download the Lalaa Ji app to sign up as a customer. This is a onetime procedure only requiring less than a minute. The customer registration process concludes as prompt messages asking to scan the merchant’s QR Code or write the unique shop identification number. On entering the details the customer becomes an online member of the shop. The merchant is also advised to register his store online on Google Business platform and share image of the printable version of his QR code.

b) Customer: A Customer is one who resides in the command area of the Merchant and through his previous shopping transactions knows about the inventory at the merchant’s shop.

c) Delivery Executive: Appointed by the Merchant, could be someone from the same locality who knows the locality thereby insuring prompt delivery.

Account Registration and Order Procedure:

The Lalaa Ji app registration process has to be initiated by the Merchant. The steps required are explained as under:

1. The merchant downloads the Lalaa Ji app and proceeds to setup his store by agreeing to the T&C.

2. Merchant generates the QR code and unique identification number and saves the printable version on his mobile phone.

3. Merchant prints the exclusive QR code and advices his regular customers to scan and download the Lalaa Ji app to linkup directly with his store to place orders. The Merchant is free to use other social media options to share his QR code to enroll his Customers with his store. Other viable option is to register his store on the Google Business and post his store’s unique QR code making it easier for his potential customer on Google Search.

4. The Customer after registration will get direct access to Merchant’s store wherein he can place orders for home delivery or pick up. The orders are placed on an excel sheet and by pushing the order button it reaches the merchant. In case of any clarification the Merchant can call the Customer by calling the mobile number mentioned on the customer’s profile. The Customer receives the intimation from the Merchant that the order has been received and under process or a regret message in case the Merchant is not in a position to deliver the order.

5. The Merchant processes the order on the same form and adds prices of each item with grand total. The Merchant sends the invoice back with total amount payable along with tentative time for the home delivery. Secific to the local retail scenario in India, a credit (Udhaar) facility has been added in the functionality of Lalaa Ji India app with a auto reminder options.

6. The Merchant arranges the home delivery logistics through his Delivery Executives who are also authorized to collect payments either by UPI/Google Pay/Paytm, cash or any other means.

7. Upon delivery the Customer checks and verifies his order makes the payment and rates the service. The Delivery Executive is authorized to mark the order as delivered and paid which removes the order from the pending list.

8. No sensitive information related to banking details, credit or debit card to be shared on the app.

9. It is for the Merchant to provide the home delivery free of cost or charge a minimum amount for the home delivery service. It should be noted that the aim of the service should be prompt delivery to avoid long outside exposure which definitely requires services of Delivery Executives, thereby creating few jobs at the local level. The onus is on the Merchant to develop his own policy for charging home delivery service based on the scale of orders, his command area and promptness as a competitive edge.

Responsibilities:

Merchant: The Merchant is responsible for the quality of goods delivered and reliability of his Delivery Executives. Further the Merchant has to insure that his premise follows all the Covid – 19 safety protocols and that his Delivery Executives are in appropriate safety gear and has been tested negative to corona and strictly follow the rules and regulations related to Covid 19 pandemic. Responsibility related to the applicable tax compliance solely rests on the Merchant.

Customer: The Customer receives the order at the entry gate of his home or gated colony, should be wearing mask and under no condition invites the Delivery Executive entrance to his home. After verifying the received order the Customer should promptly make the payment of the order received. The Customer is advised to provide the feedback by rating the service.

Delivery Executive: As per the brief of the Merchant deliver goods at the entry gate of the customer, tally the order with the customer, receive payment and maintain a safe distance during the entire exercise.

Cancellation, Return & Refunds, E&OE : Any dispute arising from returns and customers asking for refund including errors and omissions excepted (E&OE) should be resolved by the Merchant and promoters of Lalaa Ji app will not be responsible for resolving the dispute.

Data Security: The Merchant will not ask for any sensitive information (e.g. Banking) from the Customers, The information asked from the customers including image is for identifying the customer and his location, the mobile number of the customer should only be used for genuine reasons related to transactions on Lalaa Ji app, under no circumstances any aforementioned information should be shared with a third party. Any breach in this regard will result in the permanent ban of the Merchant for using Lalaa Ji app.

Use of Lalaa Ji app:

1. The app is available free of cost to the Customers.

2. A customer can link to multiple Merchants (e.g. grocery stores, vegetable venders, pharmacies, eatery, laundry, stationary shop etc from his locality by using the Lalaa Ji app provided those vendors are registered on the Lalaa Ji app and share their exclusive QR code with the customers or register with Google business to share the QR code on Google business album and other social media platforms.

3. As per the needs, the Lalaa Ji app is expected to undergo rapid improvisations; the users are therefore required to promptly update the app as per notification.

4. After the initial trial period, the merchants will be charged a nominal fee for the maintenance, support and security of the data.

5. In view of its potential for containing the spread of pandemic by minimizing the footfall of customers in the merchant’s store, Daajyu Innovations has decided to keep the Lalaa Ji app subscription free till further notice. The subscription will be charged from the merchant’s only.

You Agree and Confirm

1.That the most reliable option to combat Covid – 19 pandemic is to get vaccinated ASAP and that equally important is to wear mask, keep washing hands and avoid large gatherings to break the corona chain.

2. You fully understand that crowding a local store during limited hours might pose a threat of infection and it is therefore important to follow the rules and regulations of the Government.

3. That as local Merchant you know most of your customers and your Customers are aware of the goods available at your store and that the Lalaa Ji app is just providing you a platform to facilitate your business and that promoter of Lalaa Ji app will not be held responsible for any loss whatsoever incurred in your business.

4. That you will use the Lalaa Ji for lawful purposes only and comply with all applicable laws and regulations along with insuring strict compliance to pandemic related safety protocols.

5. As a Merchant you will not seek any sensitive banking information from your customers and only use UPI and other safe methods like Google Pay/PayTm or cash payments for your orders neither you will share the contact details of your customers.

6. That you authorize promoters of Lalaa Ji app to contact you either by phone or email to seek your feedback for improvising the app.

7. The customers and merchants are advised not to divulge any information related to banking or entertain any email, phone call or text message asking for such information or click any link whatsoever asking for receiving or making payments related to business conducted on Lalaa Ji app platform or phishing attempts disguised as discount coupons or promotional schemes.

You may not use the Lalaa Ji app for any of the following purposes:

Disseminating any unlawful, harassing, libelous, abusive, threatening, harmful, vulgar, obscene, or otherwise objectionable material.

1.Transmitting material that encourages conduct that constitutes a criminal offence or results in civil liability or otherwise breaches any relevant laws, regulations or code of practice.

2.Trading in drugs and other unlawful goods/ material and you understand that any such activity if and when noticed will be promptly reported to the concerned authorities.

Modification of Terms & Conditions of Lalaa Ji app.

Daajyu Innovations, the promoter of the Lalaa Ji app may at any time modify the Terms & Conditions of use of the Lalaa Ji app without any prior notification to you. You can access the latest version of these Terms & Conditions at any given time on this Site. You should regularly review the Terms & Conditions on the Site. In the event the modified Terms & Conditions is not acceptable to you, you are free to discontinue with the subscription. However, if you continue to use the Lalaa Ji app, you shall be deemed to have agreed to accept and abide by the modified Terms & Conditions of use of the Lalaa Ji India app or any of its edition available of the Google Play store.

Governing Law and Jurisdiction:

This User Agreement shall be construed in accordance with the applicable laws of India. The Courts at Dehradun (Uttarakhand) shall have exclusive jurisdiction in any proceedings arising out of this agreement.

Reviews, Feedback, Submissions:

All reviews, comments, feedback, ratings, suggestions, ideas, and other submissions disclosed, submitted or offered on the Lalaa Ji app website Lalaa Ji shall be and remain the property of Daaju Inovations.

Copyright & Trademark:

Daajyu Innovations reserve all intellectual property rights in all text, programs, products, processes, technology, content and other materials, which appear on this site as well as the functionality of the Lalaa Ji app.

Indemnity:

You agree to defend, indemnify and hold harmless Daajyu Innovations, its employees, directors, officers, agents and their successors and assigns from and against any and all claims, liabilities, damages, losses, costs and expenses, including attorney's fees, caused by or arising out of claims based upon your actions or inactions, which may result in any loss or liability to Daajyu Innovations or any third party including but not limited to breach of any warranties, representations or undertakings or in relation to the non-fulfillment of any of your obligations under this User Agreement or arising out of the your violation of any applicable laws, regulations including but not limited to Intellectual Property Rights, payment of statutory dues and taxes, claim of libel, defamation, violation of rights of privacy or publicity, loss of service by other subscribers and infringement of intellectual property or other rights. This clause shall survive the expiry or termination of this User Agreement.

Termination:

This User Agreement is effective unless and until terminated by either you or Daajyu Innovations. You may terminate this User Agreement at any time, provided that you discontinue any further use of the Lalaa Ji app and accordingly uninstall it from your device. Any issue related to non compliance during your usage period shall be interpreted as per aforementioned terms & conditions.

Daajyu Innovations may terminate this User Agreement at any time and may do so immediately without notice, and accordingly deny you access to the Lalaa Ji app. Such termination will be without any liability to Daajyu Innovations. Upon any termination of the User Agreement by either you or Daajyu Innovatons, you must promptly uninstall Lalaa Ji app and save your critical data.

The aforementioned T&C are for the users of the Lalaa Ji India app. Country specific functionalities have been added or disabled to various editions of the Lalaa Ji app. The country specific franchise holder may add further country specific clauses to legitimize the operations subject to prior understanding with the Daajyu Innovations.

In good faith you hereby agree to the aforementioned Terms & Conditions.
